The country's national security is a critical problem. The federal courts have an impact on how the law protects all civilians and non-citizens on matters of national security. Every individual in the world, whether a citizen or a non-citizen, has the right to be governed by the constitution. The federal courts have been at the forefront of influencing the government's decision to enforce national security concerns. In reference to the ban on immigration by President Donald Trump, James L. Robart a federal judge in Washington State imposed a restraining order to prevent the executive order by the president to ban citizens from the seven Muslim countries from entering the country. The government system has three arms which are the legislative, the executive and the judiciary. The judiciary role is the interpretation of the constitution while the executive enforces the laws made by the legislature. The checks and balances of the country describe that the judiciary can challenge a law enforced by the executive if unconstitutional.
The Muslim ban has been considered unconstitutional by some of the federal court judges’ one of them being Robart after Washington state presented a suit against the ban. The influence the federal courts have on the ability of the enforcing the ban is that the judges should first consider the laws of the country. Robart focused on the equal protection as far as the ban was concerned (Robson, Ruthann). This is because the ban is against Immigration and Nationalization Act, Religious Freedom Restoration Act, and Administrative Procedure Act. The constitution protects both citizens and non-citizens. This case shows that for the government to enforce the executive ban it should respect the constitution. This is largely influenced by the federal courts who have the ability to challenge the government decision on national security if they consider a decision unconstitutional.
