What do you think poses the biggest danger to civil society: a company that commits murders (e.g. homicide, environmental crimes, or bribery) or a corporation that commits crimes that damage corporations (e.g. misappropriation, theft, or larceny)? Defend your answer, using at least one explanation of current affairs
Both an individual and an organization pose a significant threat, especially when they commit crimes; although I believe that when a corporation engages in crimes such as environmental crimes, murder, and many other crimes, it poses a major threat compared to an individual who commits crimes such as fraud, misappropriation of funds, etc. This is because an organization can cause more harm to the community as compared to a person since the organizations have a greater influence towards the civil society.
Additionally, when comparing a corporation and an individual, the business has more access to resources, unlike an individual. For instance, some of the resources include commercial capital, lawyers, etc. All these resources make them have a high possibility of posing a significant threat when compared with an individual who has limited resources. Furthermore, the crime committed by a person is not justified to be right since it has negative effects just like the crimes that have been perpetrated by the corporations (Bricke, 2017). Concisely, the degree of harm that both causes towards the public are what determines what poses a great threat when being compared.
For instance, the Anadarko Petroleum Company committed an environmental crime that affected many people in the United States. The nuclear and rocket fuel and the wood creosote waste that the company produced caused several health problems such as Cancer that affected many people in the United States hence leading to death. The action was taken against the company, and it agreed to clean up and pay for all the cost. However, despite the company agreeing to pay the clean-up cost for their pollution, several people had already been affected by cancer, and some of them died hence this having less impact on the affected. For instance, how does that help the people who had already died due to the pollution? Or rather the pain caused to their families having released that the situation could at least be prevented.
When to form an LLC (Limited Liability Company) (Links to an external site.)Links to an external site. Discusses why the LLC is one of the most popular types of business entity. Compare an LLC with a C corporation and with an S corporation. If you were operating your own business, would you choose the LLC as the organizational form for your business? Explain your reasoning.
Limited Liability Company (LLC) has become one of the most popular types of business entity because of its important component of limited liability. For instance, a shareholder is only apt to the scope of his or rather her stock. This means that the shareholder dies not have to spite the spoils just for the sake of benefitting the business. In addition, another crucial component that makes it the most attractive is the legal framework constituent that also provides security as compared to other types.
Furthermore, when comparing between an LLC with a C corporation and a S corporation, an LLC can either choose the C Corporation since it provides a core tax benefit to the workers who are excepted from the payable income of the employee despite still being the deductive expenditures for the enterprise (Djelic, 2013). An S Corporation provides security devoid of the taxation and the filing fees that have very high costs. This is because of the limitation on diverse aspects of the organizations such as the shareholder residency.
Moreover, if I were operating my own business, I would select the LLC as the organizational form for my business because it reduces the room that would have resulted in conflict in the firm. Also, the distribution of the returns becomes easy and straightforward since the contract or rather the agreement decrees how things should be done hence circumventing the space for business argument or rather a conflict (Djelic, 2013). Additionally, the LLC will also offer the same limited liability protection just as the corporation minus the complications and bureaucracies that are concomitant with them. In a nutshell, selecting the LLC as the organizational form means that my business will develop its legitimate entity which has clear responsibilities and permissible matters.References
