The socialist argument that the family court system is biased when it comes to child support or visitation rights is examined in this essay. Second, it will consider how the court's decisions in child support or visitation cases affect non-custodial dads. These problems are important since, in divorce or separation instances, they mostly impact the fathers. The sources that will be used in the paper are Hazzard-Gaut (2006), Bell Ford (2014), and Eddy (2012) since they provide details on the family court system. Information about the problems with the family court system is presented in all of these resources. However, Eddy, 2012 discusses matters that affect the non-custodial fathers with the child support or visitation cases. Is also highlights some of the ways of improving the future of Family Court.
Part A
Current studies suggest that the court system does not discriminate against fathers after divorce procedures when it comes to access to their children(Bell Ford, 2014). The discrimination against dad can easily be seen in the community, and it remains surprising when professional says it does not exist. Ninety percent of parents who appeal in the court system to sell their children are their fathers, and the case takes six to two years to complete. In these cases, the parents are unlikely to win because the court system does discriminate against them. For example, some of the fathers are given one day to see their children and others are not given the opportunity to see their children at all. Some organizations advocate for the men’s rights. However, these organizations experience many challenges because they make a conclusion based on invalid divorce statistical findings (Hazzard-Gaut, 2006).
Apart from this, a vengeful wife may make false allegations that can affect the court decision of the father’s visitation and see the children because the woman makes the court makes a decision of protecting the children against their fathers. In most cases, the wife makes charges on everything ranging from internal fighting, stalking to child mistreatment. Finally, the Courts system usually believes a woman than a man in the current society. Currently, statistics fail to show how women are now becoming child abusers and even killers of their children. In addition to this, some mothers today emotionally blackmail and threaten their teenagers into faking ill-treatment by their father. Fathers are usually assumed capable of mistreatment of their children especially when they are taken to counseling after divorce processes
The primary audiences, in this case, are the fathers and they will benefit from hiring the message. In this case, the parents will quickly understand the terminologies used, and open discussions will be used to communicate with the audience.
Part B
The courts determine the visitation orders at the time of the divorce even though most of the non-custodian fathers complain that their partners do not respect the rights. The non-custodian parents may be allowed to visit the child on supervision using the third part, and the visitation usually takes place in a public place. The non-custodian father us often required to make use of the supervised visitation by developing the routine with the child especially during the visitation hours. A non-custodial is expected to consider the best interest of the child (Bell Ford, 2014).
Additionally, the parents are expected to work together to ensure they examined the needs of the child. A non-custodial is expected to consider the best interest of the child. Additionally, the parents are supposed to work together to ensure they examined the needs of the child (Bell Ford, 2014).
In addition to this, the Non-custodial father is expected to keep track of the child support payments he makes to the mother. In case the parent needs modification in the payments of the support, the parent needs to seek help from the attorney general. In the event of an informal agreement is made between the non-custodial father and the mother, the agreement should be put in writing, and the agreement cannot be used unless the other partner accepts the deal. All these parents are expected to seek legal advisements before making the deal. The Non-custodial father needs to pay for additional expenditures that surpass child support. They are projected to make the payments in case the parent finds it problematic to talk to the custodial parent. In case the two parents became too substantial, then both the parents can be asked to split the extra payments (Eddy, 2012).
The audiences here are both parents the custodial and non-custodial fathers. An open discussion will be used to ensure efficient communication with the parents. Finally, these parents cab quickly understand the terminologies used in the messages. Thus open group discussion will be used in the communication process.
Conclusion
Based on the investigation, the following research question was developed.
1. What are some of the issues that affect the family court system
The research question will attempt to ascertain the different social problems within the family court system. Social scientists can conduct research to identify effects of these social problems as well as determine ways of controlling the social issues within their system.
