The President's Influence on Judiciary

The president can influence judicial operations by appointing judges with whom they share ideologies. A president's philosophy also influences judiciary's decision by appointing the judges with whom they have a personal relationship. The first conclusion that one draws from the president's influence on judiciary is that the practice leads to deterioration of ethics in the society, as in the case of abortion whereby Obama appointed David Hamilton (a pro-abortion judge) to federal court (Fiedorek, 2009).  Secondly, presidential influence on judiciary leads to a decline in transparency in the appointment of judges. For instance, Obama appointed judge Andre Davis who has a reputation for delivering judgments which favor criminals (Fiedorek, 2009). Finally, president's effect on judiciary implies that judges rule in favor of the presidents who appointed them, as in the case of affordable care act where supreme court ruling favored Obama's view.


DOMA ruling on 2013 relation with the fourteenth amendment is evident in the equal protection principle. According to the 14th amendment, it is the mandate of a state to protect the people within its jurisdiction equally (McGough, 2013). Secondly, DOMA concerned the privileges and liberty of the residents of a state. Precisely, in section 1 of 14th amendment people have the liberty to association (McGough, 2013). Notably, states do not have the powers to deny people the right to marriage. Finally, the 14th amendment abhors discrimination. Therefore, denying personalities in same-sex marriages state benefits is an indication that states were discriminating against gays. Of the three issues relating to the fourteenth amendment, equal protection will have the most profound effect on the society in future because it ensures that states do not formulate policies that violate the bill of rights (McGough, 2013).
