Bob Forman's Charges


Bob Forman was found guilty of both drug possession and robbery, in which he obtained substantial profits of at least $1,000. Bob should be punished for this behavior with a maximum sentence of 15 to 20 years in jail or a maximum fine of $25,000.


Officer Smith's Arrest


Officer Smith detained Bob and his companion Pat Hester on January 1, 2016, for possessing cocaine and stolen property. Installed cameras showed that Bob and his buddy Pat were out on foot in Baltimore at 11 p.m. before being apprehended by Officer Smith. The two sounded suspicious over their act; Pat was carrying a small brown paper bag which he threw away upon seeing the officer. Bob, on the other hand, was carrying a backpack and was reluctant to handover when he was asked by Officer Smith to comply with the request. Upon searching, Officer Smith found a coke and a bag of skittles in Bob's Pocket. Officer proceeded to check on Bob's backpack and found a MacBook Computer, an IPad, Clothes, headphones, and shoes. A few minutes later a crime scene it was reported that just some few blocks away there was a loss of items matching the ones found in Bob's backpack. At the time the officer discovered the thrown brown paper bag in a bush and checked it out. Consequently, he found an ounce of cocaine in the paper bag, which with no doubt the two friends were planning to distribute. Officer was left with no option but to arrest the two suspects to wait for their Judgments.

The basis of this Sentencing Recommendation


Bob deserves a 15-20 years' incarceration as per the criminal sentencing and guidelines. The Sentencing Guidelines state that a person found with possession with intent to the distribution of illegal substances should serve less than 20 years in Jail, while a person convicted of Mugging is subjected to imprisonment for less than 15 years. Md. CRIMINAL LAW Code Ann. § 3-402 (2013) § 3-402 on Robbery forbids any person to attempt garnering other people's property with force. Bob violated this rule, and according to the law, he is supposed to serve less than 15 years in prison for convicting a felony (Government, 2010 Maryland Code CRIMINAL LAW TITLE 3 - OTHER CRIMES AGAINST THE PERSON Subtitle 4 - Robbery Section 3-402 - Robbery. Section 3-402 - Robbery.Section 3-402 - Robbery.Section 3-402-Robbery). Bob's act is not only illegal but has a negative impact on the victim. The kid lost his property and is also traumatized by the situation. It is in fact that Bob did not deny to have committed this crime scene. He confessed to the officer that he did it because his friend forced him to settle his debt. Md. CRIMINAL LAW Code Ann. § 5-602 (2013) forbids distribution and possession of prohibited and dangerous substance (Government, 2013 Maryland Code CRIMINAL LAW § 5-601 - Possessing or administering controlled dangerous substance.). Bob is indeed guilty of committing this crime with the intent of distributing the cocaine. Besides, this drug is a harmful substance and can cause complications on the victims 'body. It appears that Bob had reformed based on his past experiences. It happens that he found himself in a compromising situation, and his act was not out of his will, and now that he values his family most there is a possibility that he won't indulge himself in such a crime again.


Bob's Background


Bob's background and upbringing are not justifiable in this case. He is a grown-up and has a job which earns him some cash to sustain his family. Besides, he is now a grown man who knows what is illegal unlike when he was a kid. Also, Bob is a smart person and has excellent, outstanding records in academics, and for this, he has valuable skills, and can work to obtain his money legally without compromising his reputation.


Conclusion


From the evidence envisioned above, the court should sentence Bob for 48 months incarceration in a minimum prison, two years of probation, and a mandatory special assessment.
